These Terms & Conditions (the “Terms”) are a legal agreement between you (“you”, “your”) and Zubbin (“Zubbin”, “we”, “us”, “our”) governing your access to and use of the Z UpTimewebsite, web application, APIs, the Z UpTime WordPress plugin, and the browser monitoring widget (together, the “Service”). By creating an account, installing the plugin, embedding the widget, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Z UpTime does
Z UpTime is a monitoring platform. Depending on your plan and configuration, it can monitor the availability and health of websites, applications, APIs, scheduled jobs, and WordPress sites, and can notify you of incidents. This includes, among other things:
- Uptime/HTTP checks of URLs you configure, including TLS/SSL certificate expiry;
- WordPress health via the plugin (WordPress/PHP versions, available plugin/theme/core updates, database and REST reachability, cron status, recent fatal errors, and known-vulnerability signals);
- “Heartbeat” / dead-man's-switch monitoring for cron jobs, workers, and background tasks (we alert if an expected check-in does not arrive);
- Real-user monitoring (RUM) of page performance via an optional browser widget;
- Incident tracking, status pages, and notifications by email, webhook, and Slack.
Monitoring is provided on a commercially reasonable, best-effort basis. We do not guarantee that the Service will detect every outage or issue, that notifications will always be delivered or timely, or that the Service will be uninterrupted or error-free.
2. Your account
You are responsible for your account, for maintaining the confidentiality of your credentials and API/site tokens, and for all activity under your account. Some accounts are created automatically when the plugin is installed; where that happens, control passes to whoever verifies the associated email address. You must provide accurate information and keep it up to date.
3. Authorised use only
You agree to only monitor endpoints, sites, jobs, and applications that you own or are authorised to monitor. You must not:
- configure the Service to probe, load, or monitor systems without authorisation;
- use the Service to attack, overload, or disrupt any third party;
- interfere with or disrupt the Service, its infrastructure, or other customers;
- reverse engineer, resell, or circumvent the limits or access controls of the Service except to the extent permitted by law; or
- use the Service in violation of any applicable law.
4. Plans, billing & cancellation
The Service is offered on tiered plans (including a free tier). Paid plans are billed in advance on a recurring basis (monthly or annual) through our payment processor, Stripe. Plan limits and features — such as the number of sites and monitors, check frequency, alert channels, and other capabilities — are described at checkout and in your dashboard and may change over time.
- Subscriptions renew automatically until cancelled.
- You may cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period, and you retain paid features until then.
- Except where required by law, fees already paid are non-refundable, and we do not provide refunds or credits for partial periods, downgrades, or unused capacity.
- We may change prices with reasonable notice; changes apply to subsequent billing periods.
5. The WordPress plugin & widget
The Z UpTime plugin connects your WordPress site to the Service and periodically sends status and health data as described in our Privacy Policy. The plugin is licensed under the GPLv2 (or later). The browser widget collects anonymous performance data as described in the Privacy Policy. You can stop data transmission at any time by deactivating the plugin or removing the widget; uninstalling the plugin also removes its local settings.
6. Data & privacy
Our handling of personal data and the data sent by the plugin and widget is described in our Privacy Policy, which forms part of these Terms. You are responsible for ensuring you have the right to connect the sites and endpoints you monitor and to provide any data transmitted to us.
7. Service availability & changes
We may modify, suspend, or discontinue any part of the Service at any time. We may perform maintenance that temporarily affects monitoring. We are not liable for any interruption of monitoring, missed detections, or missed or delayed alerts.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that monitoring will be accurate, complete, or uninterrupted, or that problems will be detected or alerts delivered.
9. Limitation of liability
To the maximum extent permitted by law, Zubbin will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, or for damages arising from undetected downtime, missed or delayed alerts, or your reliance on the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.
10. Indemnity
You agree to indemnify and hold Zubbin harmless from claims, damages, and expenses arising out of your use of the Service, your content or endpoints, or your breach of these Terms or applicable law.
11. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or to protect the Service or others. On termination, your right to use the Service ends; certain provisions (including sections 8–10) survive.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be indicated by updating the date above and, where appropriate, by additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Zubbin is established, without regard to conflict-of-laws rules. [Insert governing jurisdiction and venue before publishing.]
